An ordinance to regulate the parking of vehicles on certain streets and highways; to prohibit the parking of vehicles in certain areas and zones; to provide penalties for violations; to authorize certain local officials to issue municipal civil infraction citations; and for other related purposes.
The Township of Hamlin, County of Mason, State of Michigan, ordains:
Section 1. Title
This ordinance shall be known and cited as the Hamlin Township Parking Ordinance.
Section 2. Statutory Authority
This regulatory ordinance is adopted pursuant to the Township Ordinances Act, 1945 PA 246, as amended, including MCL 41.181(1) and (2), and Chapter 87 of the Revised Judicature Act, 1961 PA 236, as amended, including MCL 600.8701(a).
Section 3. Definitions
- Park / Parking: Causing or allowing a vehicle to remain stationary longer than necessary to stop, halt, or yield for traffic or traffic control devices.
- Township: Hamlin Township, Mason County, Michigan.
- Vehicle: Any automobile, truck, trailer, motorcycle, recreational vehicle, or other motorized device regulated or required to be registered under the Michigan Vehicle Code.
Section 4. Prohibited Parking
No vehicle shall be parked on the main traveled portion of any public or private road, except in an emergency when it is impossible to move the vehicle.
No vehicle shall be parked on the shoulder or right-of-way of the following roads between 5:00 p.m. and 6:00 a.m.:
- Jebavy Drive (Lincoln River Bridge to Dewey Road)
- M-116 (Lincoln River Bridge to Lakeshore Drive)
- Lakeshore Drive (M-116 to Sugar Grove Road)
- Jagger Road (Jebavy Drive to Lakeshore Drive)
- Decker Road (Lincoln Road to Lakeshore Drive)
- Dewey Road (Lincoln Road to Lakeshore Drive)
- Sugar Grove Road (Lincoln Road to Lakeshore Drive)
- Rath Road (Jagger Road to Sugar Grove Road)
- No Name Road
- Golfwood Drive
- Lincolnwood Road
- Mound Street
- Beech Lane
- Barnhart Road (Maple Lane to Sherman Road)
Temporary delivery vehicles are exempt when properly lighted and actively loading or unloading.
- Parking while repairing or refurbishing a vehicle is prohibited except for emergency repairs.
- Parking is prohibited in crosswalks, fire lanes, bus zones, near hydrants, or blocking fire stations.
- Parking is prohibited in areas designated by official signage or temporary orders.
- Parking is prohibited in front of driveways, intersections, or alleys.
- Parking may not block emergency exits.
Section 5. Exemptions
This ordinance does not apply to emergency vehicles, utility vehicles engaged in official work, volunteer emergency responders responding to calls, or agricultural vehicles where preempted by the Right to Farm Act.
Section 6. Violation and Penalty
Violations constitute a municipal civil infraction punishable by a fine of $150 to $500 plus costs. Each day a violation continues constitutes a separate offense.
Section 7. Authorized Local Officials
- Mason County Sheriff or deputies
- Michigan State Police officers
- Hamlin Township Supervisor
- Other township officials designated by the Board
Section 8. Applicability
This ordinance applies to all persons and vehicles and does not permit any parking otherwise prohibited by law.
Section 9. Severability
If any provision is held invalid, remaining provisions remain in effect.
Section 10. Conflicting Provisions Repealed
All conflicting ordinances are repealed.
Section 11. Effective Date
This ordinance takes effect 30 days after publication as required by law.
